Terms of Service

These Terms of Service (“Terms”) govern access to and use of the datakyte platform, websites, applications, and services (collectively, the “Platform”) operated by datakyte SIA (“datakyte”, “we”, “our”, or “us”).
By accessing or using the Platform you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
1. About datakyte
datakyte provides technology that enables travel operators to distribute bookable travel inventory through digital booking links known as KLINKs.
The Platform allows travel operators, creators, and travellers to connect through a distributed booking infrastructure.
datakyte acts as a technology platform only and does not provide, organise, or operate travel services.
Travel services are provided directly by independent travel operators.
2. Definitions
For the purposes of these Terms:
Platform
The datakyte website, applications, dashboards, APIs, and booking interfaces.
KLINK
A unique booking link generated through the datakyte platform which enables access to a specific travel product or inventory.
Operator
A travel business or supplier offering travel services through the Platform.
Creator
A person or entity distributing travel content or KLINK booking links through digital channels.
Traveller
A user who accesses travel inventory or completes a booking through a KLINK link.
User
Any person accessing or using the Platform.
3. Eligibility and Use of the Platform
By using the Platform you confirm that you:
- are at least 18 years old or have legal capacity
- will use the Platform only for lawful purposes
- will not misuse or interfere with the operation of the Platform
Users must not:
- attempt to gain unauthorised access to the Platform
- scrape or extract data from the Platform without permission
- distribute malicious software
- disrupt platform infrastructure or security
datakyte reserves the right to suspend or terminate access where misuse is detected.
4. User Accounts
Certain features of the Platform require the creation of an account.
Users are responsible for:
- maintaining the confidentiality of login credentials
- ensuring account information is accurate
- all activity that occurs under their account
datakyte may suspend accounts where security risks or misuse are identified.
5. Travel Services
Travel services displayed or accessed through the Platform are provided by independent travel operators.
datakyte does not:
- organise travel experiences
- control the availability or pricing of travel services
- operate tours, accommodation, or transport services
The operator is solely responsible for:
- the delivery of the travel service
- pricing and availability
- booking confirmations
- customer service
- cancellations and refunds
Any contract for travel services is formed directly between the traveller and the operator.
6. Bookings and Payments
Bookings may be accessed through KLINK links generated via the Platform.
Payments for travel services are typically processed by the operator or the operator’s payment provider.
datakyte is generally not the merchant of record and does not process payments for travel services unless explicitly stated.
datakyte is not responsible for:
- payment disputes
- chargebacks
- refund policies set by operators
7. Creator Distribution
Creators may share KLINK links to travel products through content, social media, or other digital channels.
Creators must:
- represent travel products accurately
- comply with applicable advertising and disclosure laws
- avoid misleading or deceptive marketing practices
datakyte is not responsible for content created by third-party creators.
8. Intellectual Property
All intellectual property rights relating to the Platform, including software, branding, and design, remain the property of datakyte or its licensors.
Users may not:
- reproduce
- modify
- distribute
- reverse engineer
any part of the Platform without permission.
Operators retain ownership of their own content, including images, product descriptions, and media uploaded to the Platform.
By uploading content, operators grant datakyte a licence to display and distribute that content through the Platform.
9. Platform Availability
datakyte aims to maintain reliable platform availability but does not guarantee uninterrupted access.
The Platform may be unavailable due to:
- maintenance
- infrastructure issues
- third-party service outages
- security incidents
datakyte is not liable for losses resulting from temporary platform interruptions.
10. Third-Party Services
The Platform may integrate with third-party services including:
- reservation systems
- payment providers
- external websites
- APIs
datakyte is not responsible for the operation or policies of third-party services.
Users interacting with such services are subject to their respective terms and policies.
11. Limitation of Liability
To the fullest extent permitted by law, datakyte shall not be liable for:
- the performance of travel services provided by operators
- travel disruptions, cancellations, or accidents
- inaccuracies in travel listings
- losses arising from the use of third-party services
datakyte provides the Platform on an “as is” and “as available” basis.
12. Termination
datakyte may suspend or terminate access to the Platform if:
- a user violates these Terms
- misuse of the Platform is detected
- continued access creates legal or security risks
Users may stop using the Platform at any time.
13. Changes to the Terms
datakyte may update these Terms periodically.
Updated Terms will be published on the datakyte website.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the Republic of Latvia.
Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Latvia.
